Riga man pleads guilty in traffic fatality

June 12, 2019 -- A Riga man admitted responsibility for the death of a Greece woman in a January two-car crash in Parma, the Monroe County District Attorney's Office announced.

Prosecutors said Matthew Magar, 31, was driving drunk and traveling at between 90 and 105 mph when he struck a vehicle driven by Dilek Ogut on Jan. 7. Ogut, 41 died at the scene after Magar ran a stop sign at Parma-Clarkson Town Line and Parma Center roads and struck her car.

Magar pleaded guilty to all six counts in his indictment, including aggravated vehicular homicide, second-degree manslaughter and aggravated driving while intoxicated.

Magar, who faces 7½ to 22 years in state prison, will be sentenced June 26 by state Supreme Court Justice Alex R. Renzi.

R-H athlete charged with making terroristic threat

June 12, 2019 -- A Rush-Henrietta basketball player accused of threatening to launch a school shooting on social media was arrested and charged with making a terroristic threat, a Class D felony.

Shamir Broyld, 19, was arraigned in Henrietta Town Court one day after the Monroe County Sheriff's Department received a report of a "concerning social media post" by Broyld. He was remanded to the Monroe County Jail and held on $2,500 cash bail or $25,000 bond.

"Pretty much thinking about shooting up a school," said Capt. Paul DeLella. "It's very alarming. You can't take anything lightly."

Deputies went to Broyld's home and determined he did not have a gun or any access to one. They said he confessed to writing the message. Deputies took Broyld to Strong Hospital for evaluation before arresting him Wednesday.

Convicted RPD officer fired

June 12, 2019 -- The Rochester Police Department has fired officer Michael Sippel after his misdemeanor conviction last month, the department announced.

Sippel was convicted of third-degree assault, a misdemeanor, on May 28 by Rochester City Court Judge Thomas Rainbow Morse in a bench trial.

Sippel was found to have punched Christopher Pate in the face on May 5, 2018, during a confrontation on Bloss Street. Monroe County Assistant District Attorney Gina Clark said the action became criminal when Sippel assaulted Pate as Sippel and officer Spenser McAvoy restrained Pate. Pate suffered a broken bone in his face.

Police body-camera video showed that Pate did not at first offer his identification when approached by McAvoy. The attempt to get his ID escalated into a confrontation.

Sippel is scheduled to be sentenced July 25 and faces up to a year in jail.

Shooting death near the Rochester Public Market

June 10, 2019 -- Rochester police have identified the man shot to death near the Rochester Public Market as Deandre Jenkins, 19, of Rochester.

Jenkins was shot at least once in the torso on Fourth Street, near Garson Avenue, shortly after 11:30 p.m., said Rochester Police Department investigator Jackie Shuman.

Officers were called after it was reported that someone had been shot in the area, and emergency responders pronounced Jenkins dead at the scene.

Ogden shooting results in death

June 9, 2019 -- Quinton O'Connor, 35, is facing a second-degree murder charge after Ogden police said he shot and killed his roommate in his home.

Ogden police and Monroe County Sheriff's deputies responded to 99 Forest Meadow Trail around 4:30 a.m. and found Timothy O'Neil, 35, in the upstairs bedroom with multiple gunshot wounds.

Police said O'Neil recently moved in.

Batavia man aiding woman stabbed to death

May 31, 2019 -- A Batavia man was stabbed to death after coming to the aid of a woman who was under attack outside his apartment. Police identified the victim as Michael R. Paladino, 43.

Police arrested Quinton Edmonds, a former parolee from Rochester who is well known to police, Chief Shawn Heubusch said.

Heubusch said Edmonds was in an argument with at least one of the two women in a vehicle that was stopped on Ross Street and the dispute continued outside the vehicle.

Edmonds allegedly began striking one of the women when Paladino heard the commotion and went outside to intervene. Edmonds cut Paladino several times in the upper body and head with a sharp instrument and then fled, police said.

The women fled in the vehicle and were pulled over near the scene at the same time police were being dispatched to Ross Street. Heubusch said the women identified Edmunds as he was approaching the traffic stop as the person that was involved in the disturbance.

Edmonds was charged with second-degree murder and arraigned in Batavia City Court.

Heubusch would not say why Edmonds was on police radar prior to this incident.

Crash, suspicious death under investigation

May 31, 2019 -- A single-vehicle crash on Route 390 on led to the discovery of a suspicious death at a home on Myrtle Street.

Rochester Police Department Lt. Naser Zenelovic said the crash near West Ridge Road occurred around 5:40 a.m. A man ran from the vehicle but was later apprehended nearby by Greece police.

When New York State troopers and RPD went to the home of the vehicle's registered owner, they found a deceased male inside the residence. Police said Robert G. Hartman, 65, had been deceased for "a little bit of time" and that the death was being treated as "very suspicious."

The Monroe County Medical Examiner's Office is working to determine Hartman's cause of death.

25 years to life for cabaret performer's murder

May 29, 2019 -- The Rochester man who stabbed his girlfriend to death inside a Caroline Street apartment was sentenced to 25 years to life in state prison.

Robert Norry, 33, who was found guilty of second-degree murder in the June 2018 stabbing death of Kelly O'May, 31, was sentenced by state Supreme Court Justice Victoria Argento.

Norry fled Rochester and was taken into custody in Spokane, Wash., three days after the murder.

Hundreds gathered outside O'May's apartment days after the murder for a vigil. They shared stories about O'May, who gained recognition as a member of the Sirens & Stilettos Cabaret burlesque troup.

Police investigating fatal late-night shooting

May 28, 2019 -- Rochester police are investigating a a late-night shooting that claimed the life of 38-year-old Ricky Desantis.

Desantis was shot in the torso in the area of Wellington Avenue and Kirkland Street at around 11:30 p.m., police said. He was rushed to an area hospital, where he later died.

Judge: Sippel not justified in use of force

May 28, 2019 -- Rochester Police Department officer Michael Sippel was not justified in the force he used in May 2018 when arresting Christopher Pate on Bloss Street, City Court Judge Thomas Rainbow Morse ruled.

Sippel was found guilty of third-degree assault, a misdemeanor, by Morse in a bench trial. He will be sentenced July 25and faces a sentence of up to a year in jail.

Police body-camera video showed that Pate did not at first offer his identification when approached by Sippel's partner, officer Spenser McAvoy. The attempt to get his ID escalated into a confrontation. Monroe County Assistant District Attorney Gina Clark argued the controntation became criminal when Sippel assaulted Pate as the two officers restrained him. Pate suffered a broken bone in his face and other injuries.

"This case has never been about whether police officers can use physical force to effect a valid arrest -- they can," Morse said. "This case has never been about whether citizens can resist arrest whether it is authorized or not -- they can't. This case has always been about what happened between officers McAvoy and Sippel and Christopher Pate on the afternoon of May 5, 2018, and the legal issues surrounding that street encounter."

Both Sippel and McAvoy remain suspended with pay, pending the conclusion of an internal RPD investigation.
